Chapter 6 - The Deposition of Charles Mercer

Three weeks later, the formal preliminary hearing took place at the Mecklenburg County Courthouse in downtown Charlotte.

Nolan sat at the defense table wearing an orange correctional jumpsuit, his hands restrained by steel handcuffs, his polished, handsome appearance completely gone.

My father sat beside his defense team, his face pale, his posture slumped as the prosecution presented thirty-two separate evidence exhibits—including Dr. Rao’s video, the hospital medical reports, and the reopened 2024 traffic investigation file.

When the district attorney called Charles Mercer to the witness stand under subpoena, the room fell into dead silence.

"Mr. Mercer," the prosecutor asked, stepping up to the podium. "On the night of October 14th, 2024, when your daughter’s spine was crushed in a motor vehicle collision... who was operating the vehicle?"

My father looked at the prosecution, then at Nolan, and finally at me sitting in the front row in my matte black wheelchair.

He knew that the state had recovered the car’s airbag module data—data proving the driver’s weight matched a six-foot-two male, not a five-foot-four female.

He knew that perjury in a felony trial carried a mandatory five-year prison sentence.

My father swallowed hard, his eyes filling with tears of pure defeat.

"My son... Nolan... was driving," Charles confessed, his voice barely a whisper into the microphone.

My mother let out a strangled cry from the gallery, burying her face in her hands.

"And did you, as a former CMPD Captain, actively pressure your paralyzed daughter to lie to law enforcement to protect your son from criminal prosecution?" the prosecutor pressed coldly.

"Yes," my father whispered, lowering his head. "I did."
