Chapter 7 - GIANCARLO FERRETTI SAID EVERYONE IN MY FAMILY USED OTHER PEOPLE’S PAIN TO SURVIVE

Giancarlo’s trial began eleven months after arrest.

Fraud.

Identity theft tied Lily’s forged claim.

Conspiracy.

Burglary-related charges through son Rafael.

Wire fraud.

Corporate false statements.

Not murder.

No guns.

No empire war.

Still public.

His defense was smarter than denial.

He argued culture.

Duca culture.

My culture.

He said historical settlement trust had always been manipulated by family leadership.

He did not invent.

He produced emails.

Old executives.

My father.

Carlo.

Me.

The most damaging:

2011 email from me:

Use any lawful internal source necessary to protect liquidity. I will not lose ports over temporary market panic.

Giancarlo replied:

Historical reserve available.

Me:

If counsel approves.

There.

I had not asked what historical reserve was.

Counsel approved legal loan.

But it established attitude.

Defense claimed later claim closure was continuation of broad directive to resolve reserve.

Giancarlo said junior staff mistakenly believed Lily had verbally authorized through Maria? Ridiculous.

He denied instructing forged signature.

Rafael took plea.

That hurt.

Giancarlo’s attorney attacked.

“You stole because father?”

“Yes.”

“You want reduce sentence?”

“Yes.”

“Could be lying?”

Honest.

Then paralegal from Ferretti Bell testified.

Giancarlo personally sent Lily identity documents with instruction:

Prepare full settlement packet. She will sign once numbers presented. Do not delay for preliminary consent.

He expected post hoc ratification.

Maybe he thought money would make yes.

Like old family.

Lily testified.

Against recommendation? Her lawyer prepared.

She was nervous.

I asked:

“Do you want me courtroom?”

She smiled.

“Will you behave?”

Maria laughed.

“Yes.”

“Then okay.”

She testified:

Never applied.

Never authorized.

Did not know trust.

Would not have signed release without understanding other claimants.

Defense asked:

“You stood to receive eight million.”

“Yes.”

“Did you reject because Mr. Duca told you?”

“No.”

“Because mother?”

“No.”

“Because lawyer?”

“She advised not to sign while fraud unresolved.”

“But final decision?”

“Mine.”

“What if offer had been legitimate?”

“I might accept.”

That surprised jury maybe.

Good.

No moral saint.

Defense:

“So money tempted you.”

“Yes.”

“Eight million would tempt most people.”

“Then perhaps Mr. Ferretti reasonably believed you would agree.”

Lily looked at him.

“Believing I might say yes is not permission to sign my name before asking.”

Silence.

That was case.

Giancarlo eventually convicted on major fraud and conspiracy counts.

Acquitted on one burglary count because prosecution could not prove he specifically directed physical entry versus pendant acquisition.

Important.

Rafael convicted/pleaded separately.

The pendant had been taken.

Giancarlo benefited.

But standard.

No overclaim.

Outside courthouse, reporter asked me:

“Do you feel vindicated?”

“No.”

“Why?”

“Because company records helped create opportunity.”

“Do you blame yourself?”

“For forgery? No.”

“For governance failures? Yes.”

“Will you return CEO now?”

“I don’t know.”

Good.

Board external review concluded no evidence I knew fraudulent closure or personal siphoning.

But found:

Insufficient oversight.

Overreliance on Giancarlo.

Historic-liability blind spot.

Board offered return as executive chair under new limits.

I declined executive role.

Why?

Not martyrdom.

I had run Duca long enough.

Company now needed professional CEO not family sovereign.

Patricia asked:

“Will you remain board?”

“Nonexecutive.”

“Three-year term.”

“Subject election.”

Good.

Shareholders had say.

Not inheritance.

A woman named Evelyn Park became CEO.

Former logistics executive.

No Duca relation.

Several old family members furious.

Excellent test.

Evelyn fired two cousins for performance.

I said:

I answered:

“So are they.”

Then hung up.

Wonderful.

Under Evelyn, company repaid trust schedule faster than required because asset sales went well.

Jobs preserved mostly.

Some offices closed.

Four hundred positions cut over two years.

Pain.

Employee continuity fund helped severance/training.

My personal contribution significant.

No naming.

I did not pretend no harm.

A former employee confronted at restaurant.

“You chose dead people over my job.”

I stopped.

“I’m sorry you lost work.”

“That’s not answer.”

“No.”

“Company owed trust.”

“Could fight.”

“Yes.”

“You didn’t.”

“No.”

He walked away.

No resolution.

Some decisions hurt innocent current people.

I had to live.

Then Maria asked me to meet.

Her Queens apartment.

Daniel cooking.

Lily studying.

Normal.

Maria put pendant on table.

“I want to change something.”

“What?”

“This.”

She pushed necklace.

“I’m not giving.”

“Good.”

“I want remove Duca crest?”

I froze.

“Why?”

“It belonged to my mother.”

“She hated family word.”

“She kept because evidence.”

“Now evidence copied.”

“Trial done.”

“I want make it hers.”

“How?”

Daniel knew jeweler.

She wanted back engraved:

ELENA VASSARI — SHE KEPT HER OWN NAME

I smiled.

“Perfect.”

No need ask permission.

Crest front remained history.

Back became identity.

When pendant returned, Maria wore once.

Then gave to Lily?

Not yet.

She asked daughter:

“Do you want someday?”

“Yes.”

Maria rolled eyes.

“Charming.”

That night Daniel served too much garlic.
